These Terms of Service ("Terms") govern use of our website and attendance at our live events promoted on the website (the "Site") . By accessing the Site, purchasing a ticket, or attending an event, you accept these Terms. Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted under German law, including liability for intent, gross negligence, or injury to life, body or health.
1. Who we are
We produce and film English‑language stand‑up comedy shows in Berlin under the brand Epic Comedy Berlin (the “Organizer”, “we”, “us”). For ticketing, we use Eventbrite as our ticketing provider.
2. Ticketing via Eventbrite
Tickets are sold and processed by Eventbrite. Your purchase is additionally governed by Eventbrite’s terms and policies.
Please review Eventbrite’s Terms of Service and Payment Terms at the time of purchase in the Eventbrite checkout.
In case of conflict between these Terms and Eventbrite’s terms for matters under our control (e.g., house rules, filming consent), these Terms prevail.

3. Refunds, exchanges, rescheduling
Except where required by law, tickets are refundable up to 24 hours before the event or may be exchanged for another event date.
If an event is cancelled, you will receive a refund to the original payment method through Eventbrite.
If an event is rescheduled, your ticket will be valid for the new date. If you cannot attend the new date, you may request a refund within a reasonable period announced with the reschedule notice.
Force majeure: We are not responsible for delays or cancellations caused by circumstances beyond our reasonable control (e.g., venue closure, strikes, illness, public safety orders). In such cases, we will communicate options promptly via email and/or Eventbrite.
Transferability: Unless the Eventbrite listing states otherwise, you may transfer your ticket to another person by following Eventbrite’s transfer process.
4. Entry conditions & house rules
Age restrictions: The age policy for each show appears on its Eventbrite listing; please check the listing before purchase. Government‑issued ID may be required.
Late entry: Late entry is at the venue’s discretion and may require waiting for a suitable intermission.
Prohibited items/behaviour: Weapons, illegal substances, outside alcohol, and disruptive, harassing, or abusive behaviour are prohibited. We reserve the right to refuse admission or remove any person for safety, disruption, or breach of these Terms without refund where permitted by law.
Venue policies: Additional venue rules may apply and will be enforced by staff.
We are not the venue. The venue is independently operated and remains responsible for its premises, facilities, security staff, cloakrooms, access rules and compliance with applicable safety regulations.
Premises & property: We are not liable for loss, theft or damage to personal property on the premises. Any claims regarding the condition of the venue, facilities or security operations should be directed to the venue operator.
Instructions & policies: You must follow venue staff instructions and venue policies. Where venue rules conflict with these Terms, venue rules control for premises-related matters.
5. Filming & photography notice (audience)
We routinely film and audio‑record our shows and may take photographs. These recordings are used to produce short‑form and long‑form clips and other media.
Where recordings may appear: Our website and official social‑media accounts (including but not limited to Instagram, TikTok, YouTube/Shorts, Facebook, Threads, Pinterest, LinkedIn, and X/Twitter), our promotional materials, and editorial coverage.
What this means for you:
By purchasing a ticket and/or entering the venue, you acknowledge that the event is recorded and you may appear incidentally or recognisably in audience shots.
You grant us a non‑exclusive, worldwide, royalty‑free licence to use, reproduce, adapt, and communicate your image and voice captured at the event in connection with our shows and brand, in any media now known or later developed, for editorial and promotional purposes, without further consent or payment, to the fullest extent permitted by law.
We will not use your image in a manner that is unduly derogatory or misleading.
Opt‑out protocol for audience close‑ups:
We understand some guests may not wish to be featured in close‑up audience reactions.
If you wish to avoid close‑ups or featured shots, please inform our staff in person at the show before seating begins. We will make reasonable efforts to seat you in an area less likely to be filmed closely. You may also inform us after the show and we will do our best to blur or remove you from any video used for our content.
No designated “no‑camera” zones are guaranteed, and incidental appearances may still occur (e.g., wide crowd shots).
Post‑event takedown requests for already published clips will be considered case‑by‑case; where feasible, we may re‑edit or blur, but we cannot guarantee removal across all platforms or third‑party shares.
Performers: Performers’ appearances are governed by separate performer agreements and are not covered by this audience filming notice.
6. Intellectual property
All content on the Site and in our published clips (including video, audio, logos, graphics, text, and trademarks) is owned by or licensed to us and is protected by law.
You may not copy, adapt, re‑upload, or exploit our content without prior written permission, except as permitted by mandatory law.
7. Website use
Do not misuse the Site, interfere with security, or attempt unauthorised access.
Third‑party links (including Eventbrite) are provided for convenience; we are not responsible for their content or policies.
We may modify, suspend, or discontinue parts of the Site at any time.
8. Privacy & data protection (summary)
We act as data controller for personal data processed via the Site and at events. Full details are provided in our Privacy Policy (linked on the Site). Key points:
Categories: Ticketing data (processed by Eventbrite), operational communications, event recordings (video, photo, audio), and analytics.
Purposes & legal bases:
Ticketing and event administration (contract performance);
Safety and house management (legitimate interests);
Recording and publishing event clips for brand communication and documentation (legitimate interests);
Compliance with legal obligations.
Retention: Ticketing/transaction records per statutory requirements; raw recordings and published clips retained for the life of the project/brand unless otherwise stated in the Privacy Policy.
Rights: You have rights of access, rectification, erasure, restriction, objection (including to processing based on legitimate interests), and data portability, subject to legal limits.
Requests: Contact us at info@epiccomedyberlin.com. You also have the right to lodge a complaint with your local supervisory authority (e.g., Berliner Beauftragte für Datenschutz und Informationsfreiheit).
9. Disclaimers & liability
Comedy is subjective and may include adult themes. Viewer and attendee discretion is advised.
Nothing in these Terms limits liability where such limitation is prohibited by law, including liability for intent, gross negligence, injury to life, body, or health.
Subject to the foregoing, and to the extent permitted by law, our aggregate liability to you for foreseeable losses arising from or in connection with these Terms, the Site, or an event is limited to the price you paid for your ticket(s).
10. Changes to these Terms
We may update these Terms from time to time. The effective date above shows the latest version. Continued use of the Site or attendance at events after updates constitutes acceptance of the revised Terms.
11. Governing law & venue
These Terms are governed by the laws of Germany. Exclusive place of jurisdiction, where permitted, is Berlin, Germany.
